Jack Faller Faces Nine Month Suspension by FINRA
Jack Faller (CRD #: 1883661), a broker formerly registered with Crescendo Markets, has been suspended by FINRA, according to his BrokerCheck record, accessed on January 6, 2025. Read on to learn more about his alleged conduct as a broker.
FINRA Suspension
On December 11, 2024, Jack Faller consented to the entry of findings that he allegedly created false reports of branch inspections he completed at Monmouth Capital Management in 2020 and 2021, when in fact he had not conducted those inspections.
Firms are required under FINRA Rule 3110(c) to conduct office inspections to ensure they are complying with FINRA rules and securities regulations.
A Letter of Acceptance, Waiver & Consent (AWC) alleged that Jack Faller was responsible for inspections of the firm’s branch office between May 2019 and January 2022, but failed to produce any office inspection reports.
On March 2, 2023, Monmouth Capital Management’s then-Chief Compliance Officer (CCO) allegedly requested copies from Jack Faller of branch inspection reports for 2020 and 2021 in response to a FINRA Rule 8210 request. This rule requires firms to provide documents and information requested in connection with FINRA investigations.
Jack Faller allegedly disclosed to the CCO that he did not complete the inspections for those years and offered to create the reports, despite having not been associated with the firm for more than a year. He allegedly only dated one of these reports, falsely indicating that the 2021 report had been reviewed in that year.
On March 7, 2023, the CCO allegedly provided these reports to FINRA without disclosing they were created recently.
The AWC concluded that these allegations constitute violations of FINRA Rule 4511 and 2010.
FINRA Rule 4511
FINRA Rule 4511 requires firms to maintain accurate books and records.
FINRA Rule 2010
FINRA Rule 2010 holds brokers to high standards of commercial honor and just and equitable principles of trade.
